Kitesurfari is a brand of Scale to Zen Limited, a company incorporated in Hong Kong (Business Registration No. 79465132). References to "Kitesurfari", "we", "us", or "our" in these Terms & Conditions refer to Scale to Zen Limited trading as Kitesurfari.
By submitting a tour application or making a booking with Kitesurfari, you confirm that you have read, understood, and agree to these Terms & Conditions. These terms govern your participation in all Kitesurfari tours and activities.
Your place on a tour is confirmed upon receipt of your deposit (50% of the total tour price). The remaining balance is due no later than 60 days before your departure date. For bookings made within 60 days of departure, full payment is required at the time of booking.
Kitesurfari reserves the right to release your place if payment is not received by the due date.
All cancellations must be submitted in writing to kite@kitesurfari.co. The following cancellation policy applies:
We strongly recommend comprehensive travel insurance that includes cancellation cover.
Kitesurfari reserves the right to cancel or postpone a tour if minimum participant numbers are not reached, or due to circumstances beyond our control including extreme weather, natural disaster, civil unrest, or force majeure events. In the event of cancellation by Kitesurfari, a full refund of all monies paid will be provided. Kitesurfari accepts no liability for additional costs incurred (including flights, visas, or other travel expenses).
Kitesurfing is a physical activity that carries inherent risks. By booking a Kitesurfari tour, you confirm that you are in good health, physically fit to participate, and have disclosed any relevant medical conditions. Kitesurfari reserves the right to refuse participation to any person deemed by the guide or instructor to pose a risk to themselves or others.
Participants must be at least 18 years of age, or 16–17 with written parental consent.
Kitesurfing and associated adventure activities involve inherent risks including but not limited to injury, equipment failure, adverse weather, and unpredictable ocean conditions. By participating in a Kitesurfari tour, you voluntarily assume all such risks.
To the maximum extent permitted by law, Kitesurfari, its employees, guides, instructors, and agents accept no liability for any injury, illness, loss, damage, delay, or additional expense incurred before, during, or after a tour, whether caused by negligence or otherwise.
Comprehensive travel insurance is required for all participants. Your policy must cover medical expenses, emergency evacuation, personal liability, and ideally cancellation and kitesurfing as a named activity. Kitesurfari accepts no responsibility for costs arising from inadequate insurance coverage.
It is your responsibility to ensure you hold a valid passport and any required visas for your destination. Kitesurfari accepts no responsibility for denied boarding or entry due to inadequate documentation.
Kitesurfari does not guarantee wind conditions. Kite sessions are subject to weather and conditions on the day, at the discretion of the local guide or instructor. No refunds will be given for sessions cancelled due to unsuitable wind or weather. Alternative activities will be offered where possible.
All participants are expected to treat fellow crew members, guides, instructors, and local communities with respect. Kitesurfari reserves the right to remove any participant from a tour at their own expense if their behaviour is deemed unsafe, disruptive, or harmful to others. No refund will be provided in such circumstances.
By participating in a Kitesurfari tour, you grant Kitesurfari a non-exclusive, royalty-free licence to use photographs and video taken during the trip for promotional purposes including our website and social media. If you prefer not to appear in promotional materials, please notify us in writing before departure.
Kitesurfari reserves the right to modify itineraries, accommodation, activities, or logistics due to operational requirements, weather, safety considerations, or other circumstances beyond our control. We will endeavour to provide alternatives of equivalent value where substitutions are necessary.
These Terms & Conditions are governed by the laws of the Hong Kong Special Administrative Region. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong SAR.
